1. Introduction and Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NexCure Healthcare Technologies Private Limited ("NexCure," "Company," "we," "us," or "our"), governing your access to and use of the NexCure website, mobile applications, and all associated services.

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Services

NexCure is an AI-powered healthcare technology platform designed to assist Users in identifying suitable medical practitioners based on reported symptoms, scheduling appointments, communicating with healthcare providers, and securely managing personal health information.

NOTE: NexCure is a technology intermediary that facilitates access to healthcare information and licensed medical professionals. NexCure is not a hospital, clinic, or medical practice, and does not itself provide medical treatment.

3. Eligibility and User Accounts

To use the Platform, you must be at least 18 years of age or the age of majority in your jurisdiction, or be using the Platform under the supervision of a parent or legal guardian. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. The NexCure AI Health Assistant

The NexCure AI health assistant uses artificial intelligence and machine learning technologies to provide general, educational, and informational guidance based on symptoms and information voluntarily submitted by the User.

CAUTION: THE AI ASSISTANT DOES NOT DIAGNOSE MEDICAL CONDITIONS, DOES NOT PRESCRIBE MEDICATION OR TREATMENT, AND DOES NOT REPLACE CONSULTATION WITH A LICENSED MEDICAL PRACTITIONER. THE AI ASSISTANT IS NOT DESIGNED OR INTENDED FOR USE IN MEDICAL EMERGENCIES.

5. Medical Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND YOUR HEALTH-RELATED DECISIONS.
  • No use of the Platform creates a doctor-patient relationship between the User and NexCure.
  • The Platform is not designed, intended, or suitable for the provision of emergency medical services.
  • Users are strongly advised to consult a licensed, qualified medical professional for all diagnosis, treatment, medication, and health-related decisions.
  • Any medical consultation provided by a Doctor through the Platform is rendered solely by that Doctor in their independent professional capacity.

6. User and Doctor Responsibilities

Users agree to provide accurate information, not misuse the platform, and conduct themselves respectfully. Doctors registered on the Platform independently represent that they hold valid medical licenses and exercise independent professional medical judgment. NexCure does not supervise or control the clinical judgment of any Doctor.

7. Limitation of Liability

To the fullest extent permitted by applicable law, NexCure shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including damages resulting from inaccuracies in AI output, technical failures, or clinical decisions provided by any Doctor using the Platform.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts situated at Noida, Uttar Pradesh, India.
